These Contact Form Terms and Conditions govern the use of forms, application forms, enquiry forms, booking tools and file-upload facilities made available by Tyche Technologies LLC through gotyche.com and any related webpage operated by Tyche.

Please read these Terms before submitting a Form.

1. About These Terms

In these Terms:

• “Tyche”, “we”, “us” or “our” means Tyche Technologies LLC, Dubai, United Arab Emirates.

• “Website” means gotyche.com and any webpage operated by Tyche.

• “Form” means any contact, enquiry, proposal, quotation, membership, support, booking or similar form made available through the Website.

• “You” or “your” means the person submitting a Form and, where applicable, the business or organisation that person represents.

• “Submission” means the information, documents, links and other material provided through a Form.

These Terms apply to Forms including:

• General contact and enquiry forms

• Talk to Tyche forms

• Request a Proposal forms

• Get a Quote forms

• Tyche Membership applications

• Meeting and consultation booking forms

• Project enquiry forms

• Support forms

• File-upload fields associated with any Form

By ticking the relevant acceptance box and submitting a Form, you confirm that you have read and agreed to these Terms.

Your acceptance of these Terms applies only to your use of the Forms. It does not, by itself, create an agreement for Tyche to provide services.

2. Eligibility and Authority

You must be at least 18 years old and have the legal capacity to submit a Form.

If you submit a Form on behalf of a company, organisation or another person, you confirm that:

• You are authorised to provide the information submitted.

• You are authorised to communicate with Tyche on their behalf.

• The information you provide does not breach any duty owed to another person.

• Any personal information relating to another person has been collected and shared lawfully.

Submitting a Form does not necessarily mean that you are authorised to enter into a service agreement on behalf of the organisation. Tyche may request separate confirmation of your authority before accepting a project, proposal or membership arrangement.

3. Permitted Use

The Forms may only be used for genuine enquiries relating to Tyche, its services, solutions, projects, membership, support or business opportunities.

You must not use a Form to:

• Submit false, inaccurate or misleading information.

• Impersonate another person or organisation.

• Send spam, unsolicited advertising or unrelated sales messages.

• Submit unlawful, abusive, threatening, discriminatory or defamatory material.

• Upload malicious code, viruses, corrupted files or harmful software.

• Attempt to interfere with the Website, Forms or connected systems.

• Circumvent security, validation, rate-limiting or anti-spam measures.

• Collect information about Tyche, its employees or its users without authorisation.

• Submit information obtained unlawfully.

• Infringe another person’s intellectual-property, confidentiality, privacy or contractual rights.

• Use automated tools to send bulk or repetitive submissions without Tyche’s written permission.

Tyche may block, disregard or delete Submissions that appear fraudulent, abusive, unlawful, irrelevant or technically harmful.

4. Accuracy of Your Information

You agree to provide information that is accurate, current and reasonably complete.

You should notify Tyche if important information changes after you submit a Form, particularly information affecting:

• Your identity or authority

• Your contact details

• Your requirements

• The intended project scope

• Relevant deadlines

• Budget or investment expectations

• Applicable technical, security or regulatory requirements

Tyche may rely on the information you provide when deciding whether to respond, preparing a proposal or assessing whether a project or membership relationship is suitable.

Tyche is not responsible for delays, unsuitable recommendations or incorrect estimates resulting from inaccurate, incomplete or outdated information supplied by you.

5. What a Submission Means

Submitting a Form is a request for Tyche to review your information and, where appropriate, contact you.

A Submission does not:

• Require Tyche to accept an enquiry, application or project.

• Guarantee that Tyche will provide a proposal or quotation.

• Guarantee acceptance into Tyche Membership.

• Reserve Tyche’s availability or delivery capacity.

• Confirm a project scope, price or delivery date.

• Create a client, employment, agency, partnership, fiduciary or exclusive relationship.

• Create an obligation for either party to purchase or provide services.

• Constitute professional legal, tax, financial, investment, regulatory or medical advice.

A binding service relationship begins only when Tyche and the relevant client enter into a separate written agreement, proposal, statement of work, order form or membership agreement accepted by authorised representatives.

6. Proposal and Quotation Requests

Information provided through a Request a Proposal or Get a Quote Form helps Tyche understand your requirements. It is not a final project specification.

Any initial pricing, timing, scope or feasibility information communicated before a formal proposal is issued is preliminary and non-binding.

A formal proposal may contain:

• Project assumptions

• Deliverables and exclusions

• Client responsibilities

• Timelines and dependencies

• Fees, payment terms and applicable taxes

• Third-party costs

• Change-control arrangements

• Intellectual-property terms

• Confidentiality obligations

• Support and maintenance terms

• Proposal validity period

Pricing or timelines may change if:

• The original information was incomplete or inaccurate.

• The requirements or scope change.

• Additional integrations, licences or third-party services are required.

• Security, regulatory or data-processing requirements are identified.

• External supplier pricing or availability changes.

• Client approvals, content, access or dependencies are delayed.

If a formal proposal conflicts with these Form Terms, the formal proposal will govern the proposed services. These Terms will continue to govern the original Form Submission.

7. Tyche Membership Applications

Submitting a Tyche Membership application does not guarantee acceptance.

Tyche may evaluate applications based on factors including:

• Business requirements

• Requested areas of ownership

• Strategic and operational fit

• Timing and readiness

• Available delivery capacity

• Decision-making authority

• The information supplied in the application

The membership price displayed in the application is provided for transparency. Confirming that the stated investment may be suitable does not create a subscription, payment obligation or reservation.

Membership begins only after:

1. Tyche confirms acceptance.

2. The parties agree to the applicable membership terms.

3. Any required agreement is accepted.

4. The required payment arrangements are completed.

The separate Tyche Membership Agreement will govern the membership, including its services, duration, price, payment terms, capacity, exclusions and cancellation provisions.

8. Meeting and Call Bookings

A booking confirmation indicates that a meeting has been scheduled, subject to availability and any information provided with the confirmation.

Tyche may reasonably reschedule or cancel a meeting due to availability, technical issues or operational requirements.

You should notify Tyche as early as reasonably possible if you cannot attend. Repeated missed appointments may result in further booking requests being declined.

A meeting, discovery call or consultation does not guarantee:

• Project acceptance

• Membership acceptance

• A proposal

• A specific recommendation

• A particular outcome

• Availability on a requested date

Meetings may take place using third-party communication services such as Google Meet, Microsoft Teams, Zoom, telephone or WhatsApp. Your use of those platforms may also be governed by their applicable terms and privacy policies.

A meeting will not be recorded unless appropriate notice is provided and any required permission has been obtained.

9. Communications From Tyche

By submitting a Form, you authorise Tyche to contact you about the specific enquiry, application, booking or support request using the contact details and preferred communication method you provide.

This may include communication by:

• Email

• Telephone

• WhatsApp

• Video call

• Calendar invitation

These operational communications are used to respond to your request. They are different from optional general marketing communications.

Tyche should only send general news, insights, promotions or offers when you have separately requested or consented to receive them, or where otherwise permitted by applicable law.

You may withdraw marketing consent or unsubscribe at any time. Withdrawing marketing consent will not prevent Tyche from sending communications necessary to respond to an active enquiry, administer an application, provide requested support or fulfil an existing agreement.

If you choose WhatsApp, telephone or another third-party communication service, your network provider’s charges and the platform provider’s terms may apply.

10. Personal Information

When you submit a Form, Tyche may collect information including:

• Your name

• Email address

• Telephone or WhatsApp number

• Preferred contact method

• Company or brand name

• Job title or role

• Website or social-profile links

• Industry

• Business location

• Business stage

• Project requirements

• Requested services

• Timelines and objectives

• Budget or investment information

• Application answers

• Uploaded documents and links

• Booking information

• Consent and submission records

The Website or its service providers may also collect technical and attribution information, including:

• IP address

• Device and browser information

• Submission date and time

• Landing-page URL

• Referring URL

• UTM source

• UTM medium

• UTM campaign

• Advertising or click identifiers

• Security and anti-spam information

Tyche may process this information, as permitted by applicable law, to:

• Receive and respond to your Submission.

• Verify contact information or authority.

• Understand your requirements.

• Assess project or membership suitability.

• Arrange meetings.

• Prepare proposals or quotations.

• Maintain enquiry and relationship records.

• Provide requested support.

• Detect fraud, abuse, spam and security threats.

• Understand how enquiries reach Tyche.

• Improve the Website, Forms and enquiry process.

• Establish, exercise or defend legal rights.

• Meet legal, regulatory and accounting obligations.

Further information about the collection, use, storage, sharing, retention and protection of personal information must be provided in Tyche’s separate Privacy Policy.

If these Terms and the Privacy Policy conflict regarding the processing of personal information, the Privacy Policy will apply, subject always to applicable law.

11. Service Providers and International Processing

Tyche may use authorised service providers to operate the Website and manage Submissions, including providers of:

• Website hosting

• Form processing

• Email delivery

• Customer-relationship management

• Cloud storage

• Analytics and attribution

• Spam and fraud prevention

• Meeting scheduling

• Telephone and messaging services

• Technical support

These providers may process information on Tyche’s behalf and may operate from countries outside the United Arab Emirates.

Where required by applicable law, Tyche will use appropriate contractual, organisational or technical measures for international transfers and service-provider access.

Tyche does not sell personal information submitted through its Forms.

12. Information You Should Not Submit

Unless Tyche specifically requests it and provides an appropriate method for transferring it, do not submit:

• Passwords or login credentials

• Payment-card details

• Bank-account credentials

• Government identity documents

• Medical or patient records

• Biometric information

• Information about children

• Highly sensitive employee information

• Production-system secrets or encryption keys

• Unpublished source code

• Confidential datasets

• Trade secrets

• Information subject to professional secrecy

• Information restricted by law or contract

If sensitive or confidential information is necessary for an enquiry, contact Tyche first so an appropriate transfer method or confidentiality arrangement can be considered.

If you accidentally submit sensitive information, contact Tyche promptly and identify the relevant Submission.

13. Uploaded Files, Links and Materials

You retain ownership of documents, files and other original material submitted through a Form.

By submitting material, you grant Tyche a limited, non-exclusive permission to receive, store, copy, review and internally share that material only as reasonably necessary to:

• Evaluate your enquiry or application

• Communicate with you

• Prepare a proposal

• Assess technical or commercial requirements

• Protect Tyche’s systems

• Meet applicable legal obligations

You confirm that:

• You own the submitted material or have permission to provide it.

• Tyche may review it for the purpose of responding to your Submission.

• It does not unlawfully infringe another person’s rights.

• It does not contain malicious code or intentionally harmful content.

Tyche does not acquire ownership of your material merely because it was submitted through a Form.

Unless a separate confidentiality or non-disclosure agreement has already been entered into, submitting information does not automatically create contractual confidentiality obligations beyond Tyche’s obligations under applicable privacy law and its published Privacy Policy.

You should therefore avoid submitting commercially sensitive information until appropriate confidentiality arrangements have been agreed.

14. Third-Party Websites and Services

The Forms may connect with third-party platforms for hosting, scheduling, analytics, communications, storage or security.

Tyche selects and manages service providers with reasonable care but does not control every aspect of their availability, infrastructure or independent processing.

Tyche is not responsible for the content or practices of an external website merely because the Website links to it.

Where you interact directly with a third-party service, that provider’s own terms and privacy policy may also apply.

15. Security and Form Availability

Tyche uses reasonable organisational and technical measures intended to protect Form Submissions. However, no internet transmission or storage system can be guaranteed to be completely secure.

You are responsible for choosing an appropriate method for sending particularly sensitive or confidential information.

Tyche does not guarantee that:

• Every Form will always be available.

• Every Submission will be delivered without delay.

• Third-party services will operate without interruption.

• A confirmation message proves that every part of a Submission was received correctly.

• The Website will be free from every error or technical issue.

16. Preliminary Information and No Professional Advice

Information available on the Website or provided in an initial response is for general business discussion.

Unless a separate written agreement expressly states otherwise, it should not be treated as:

• Legal advice

• Tax advice

• Financial or investment advice

• Medical advice

• Regulatory approval

• A security certification

• A guarantee of business, marketing or technology results

You remain responsible for obtaining appropriate professional advice and making your own commercial decisions.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Tyche will not be liable for indirect, incidental, special, punitive or consequential losses arising solely from:

• Your use or inability to use a Form.

• Delay or failure in transmitting a Submission.

• Reliance on preliminary or incomplete information.

• Loss caused by inaccurate information supplied by you.

• An outage or failure of a third-party platform.

• Unauthorised or unlawful material submitted by another person.

• Your decision to transmit sensitive information through an unsuitable channel.

Where liability cannot lawfully be excluded, Tyche’s liability under these Terms will be limited to direct and reasonably foreseeable loss caused by Tyche’s proven breach of these Terms.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct or any mandatory statutory right that cannot be excluded.

Any liability connected with paid services will be governed by the applicable service agreement, proposal, statement of work or membership agreement.

18. Responsibility for Misuse

You are responsible, subject to applicable law, for reasonably foreseeable losses, claims or costs caused by:

• Your unlawful use of a Form.

• Your intentional submission of malicious material.

• Your impersonation of another person.

• Your unauthorised disclosure of another person’s information.

• Your infringement of intellectual-property or confidentiality rights.

• A material breach of the confirmations you make under these Terms.

Tyche may restrict Form access, block further Submissions or report suspected unlawful conduct to the appropriate authority where reasonably necessary.

19. Changes to These Terms

Tyche may update these Terms to reflect changes in:

• The Forms or Website

• Tyche’s services

• Operational practices

• Technology or service providers

• Legal or regulatory requirements

The updated version will be published on this page with a revised “Last updated” date.

The version displayed when you submit a Form will normally govern that Submission. Changes will not apply retrospectively where retrospective application would be unlawful or materially unfair.

20. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai.

Before commencing formal proceedings, you and Tyche should attempt in good faith to resolve a dispute by written communication.

If a dispute cannot be resolved, it will be subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates, unless mandatory applicable law requires otherwise.

Nothing in this section prevents either party from seeking urgent protective or injunctive relief where legally available.

Visitors outside the United Arab Emirates may also have mandatory rights under laws applicable to them. Nothing in these Terms is intended to remove a right that cannot legally be waived.

21. Relationship With Other Agreements

These Terms govern the submission and handling of Forms.

If you later enter into another written agreement with Tyche:

• The service agreement, proposal or statement of work will govern the relevant project.

• The Tyche Membership Agreement will govern an accepted membership.

• The Privacy Policy will govern the processing of personal information.

• Any signed non-disclosure agreement will govern the confidential information covered by it.

Where there is a conflict, the more specific applicable agreement will take priority for its subject matter.

22. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or adjusted only to the minimum extent necessary.

A delay by Tyche in enforcing a provision does not waive its right to enforce that provision later.

You may not transfer your rights under these Terms to another person without Tyche’s written consent. Tyche may transfer its rights and obligations as part of a lawful corporate restructuring, business transfer or change in ownership, subject to applicable data-protection requirements.

Headings are included for readability and do not affect interpretation.

If these Terms are translated, the English version will prevail to the extent permitted by applicable law.
